You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

RentSure provides a cloud-based property management platform designed to assist landlords and property managers with:

• Property portfolio management and tracking
• Tenancy management and tenant records
• Compliance monitoring and deadline tracking
• Rent collection and payment management
• Document storage and management
• Automated notifications and reminders

The Service is provided as a software-as-a-service (SaaS) solution and is intended to assist with property management tasks. The Service does not constitute legal, financial, or tax advice.

4. Account Registration and Security

To access the Service, you must register for an account by providing accurate, current, and complete information. You agree to:

• Maintain the accuracy of your account information
• Keep your login credentials confidential and secure
• Immediately notify us of any unauthorised access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that we reasonably believe have been compromised.

5. Subscription and Payment

5.1 Subscription Plans

The Service is offered on a subscription basis at £10 per month. We may offer additional pricing tiers or features from time to time. Current pricing is available on our website.

5.2 Free Trial

New users may be eligible for a 14-day free trial. At the end of the trial period, your subscription will automatically commence unless you cancel before the trial ends.

5.3 Billing and Payment

Subscription fees are billed in advance on a monthly basis. All payments are non-refundable except as expressly stated in these Terms or as required by applicable law. If a payment fails, we may suspend access to the Service until payment is received.

5.4 Price Changes

We reserve the right to modify our pricing. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems to access the Service without our prior written consent

You remain solely responsible for ensuring your use of the Service complies with all applicable landlord and tenant legislation, including but not limited to the Housing Act 2004, the Tenant Fees Act 2019, and relevant regulations concerning deposit protection, gas safety, and energy performance certificates.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all content, features, and functionality, is owned by RentSure and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your internal business purposes during the term of your subscription.

7.2 Your Content

You retain ownership of all data and content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

8. Limitation of Liability

In no event shall RentSure be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Cost of procurement of substitute services
• Damages arising from your reliance on the Service for compliance decisions

Nothing in these Terms shall limit or exclude our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be lawfully limited or excluded under English law

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The Service will meet your specific requirements
• Any errors in the Service will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless RentSure, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any rights of a third party.

11. Suspension and Termination

11.1 Termination by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately if: (a) you breach these Terms; (b) you fail to pay applicable fees; (c) we are required to do so by law; or (d) we cease to offer the Service.

11.3 Effect of Termination

Upon termination, your right to access the Service will immediately cease. We will retain your data for 30 days following termination, during which time you may request an export of Your Content. After this period, we may delete your data in accordance with our data retention policies.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must cancel your subscription before the changes take effect.

Before initiating any formal legal proceedings, you agree to first contact us at legal@rentsure.co.uk to attempt to resolve the dispute informally. We will endeavour to resolve any disputes within 30 days of receipt of your notification.

If informal resolution is unsuccessful, either party may pursue their legal rights through the courts of England and Wales as set out in Section 13.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable whilst preserving the original intent of the parties.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and RentSure regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
