Rent Smart Wales (2015)
Wales was the first UK nation to introduce mandatory landlord registration and licensing.
Renting Homes Act (2022)
The Renting Homes (Wales) Act 2016 came into force in December 2022, replacing ASTs with Standard Occupation Contracts.
No Right to Rent
Unlike England, Wales does not require landlords to conduct Right to Rent immigration checks.
Contract Holders
Tenants are now called 'contract holders' and receive a 'written statement' instead of a tenancy agreement.
Fitness for Habitation
Enhanced standards require properties to be fit for human habitation throughout the tenancy.
Six-Month Protection

Rent Smart Wales Registration
All landlords letting property in Wales must register with Rent Smart Wales. This is a legal requirement since November 2015.
Rent Smart Wales Licence
Self-managing landlords must also obtain a licence. Involves training and a 'fit and proper person' test.
Standard Occupation Contract
Must use SOC instead of AST. Provide written statement within 14 days of occupation.
Fitness for Human Habitation
Property must be fit for human habitation. HHSRS (Housing Health and Safety Rating System) standards apply.
PAT Testing
Test all landlord-supplied electrical appliances. Critical for HMOs and best practice for all rentals.
Legionella Risk Assessment

Understanding the Renting Homes (Wales) Act
The Renting Homes (Wales) Act 2016 came into force on 1 December 2022, fundamentally changing how residential tenancies work in Wales. Here's what you need to know:
Standard Occupation Contracts
ASTs are replaced by Standard Occupation Contracts (SOCs) for private landlords. The key document is now a 'written statement'.
14-Day Written Statement
Landlords must provide a written statement within 14 days of occupation. Failure allows tenants to claim compensation.
Contract Holders
Tenants are now legally called 'contract holders'. They have enhanced rights including automatic succession rights.
Six-Month Occupation
Landlords cannot serve a no-fault possession notice until the contract holder has been in occupation for at least 6 months.
Deposit Protection
Deposits must still be protected within 30 days. The same three government-approved schemes apply.
Fitness Standard
Properties must be fit for human habitation at the start and throughout the contract.
Important: Existing Tenancies
All existing ASTs in Wales automatically converted to Standard Occupation Contracts on 1 December 2022. If you haven't already, you should provide contract holders with an updated written statement.

Gas Safety Certificate
Annual inspection of all gas appliances by Gas Safe registered engineer.
EICR Inspection
Electrical Installation Condition Report for all rental properties.
EPC Certificate
Energy Performance Certificate with minimum E rating required.
Smoke & CO Alarms
Working alarms on each floor. CO alarms where solid fuel is used.

HMO Requirements in Wales
Mandatory HMO Licence
A mandatory HMO licence is required if your property is occupied by:
- 5 or more people
- Forming 2 or more separate households
- Sharing facilities (kitchen, bathroom, toilet)
Additional Requirements
HMO landlords in Wales must also:
- Be registered AND licensed with Rent Smart Wales
- Comply with fire safety regulations
- Check for local additional/selective licensing schemes
- Maintain minimum room sizes
